If you’re deploying AI tools globally — and increasingly, who isn’t — this parallel movement matters. The compliance environment for AI is getting simpler on both sides of the Atlantic. Not necessarily weaker. Simpler. That’s a meaningful distinction, and it affects how you should think about future AI infrastructure decisions.

What Should Your Business Do Right Now?

This is the part where I stop describing the policy debate and start talking about what it means for the people actually deploying AI tools.

Don’t wait for the final legislation to start preparing. Whether federal preemption passes or not, the current state-level patchwork is already a compliance risk. And the GUARDRAILS Act alternative would create its own set of requirements. Waiting for legislative clarity means you’re reacting instead of preparing.

Here’s what I’d prioritize:

1. Audit your current AI deployments by state exposure

Know which states you operate in, which AI systems you deploy there, and which state-level regulations currently apply to those deployments. If you’re using AI tools for legal work, healthcare, hiring, lending, or insurance — you’re almost certainly touching high-risk categories that multiple states regulate differently.

2. Build for the strictest standard, not the loosest

This is table stakes regardless of which bill passes.

4. Watch the liability question closely

If developers can’t be held liable for how their models are used, the liability shifts further toward deployers — meaning you.
